The rules for businesses using the Apointo platform: what the service includes, mutual rights and obligations, payment, termination and liability.
Effective October 27, 2026
This translation is for information only; the Serbian text prevails.
1. General
These terms govern the use of the Apointo platform (the “Service”) provided by [NAZIV PRAVNOG LICA], [ULICA I BROJ, POŠTANSKI BROJ, MESTO], registration number [MATIČNI BROJ], tax ID [PIB] (“Apointo”).
The Service is intended for businesses and sole traders that provide services to their own clients by appointment (the “Customer”). By opening an account or accepting an offer, the Customer accepts these terms and the Data Processing Agreement, which forms part of them.
2. The service
The Service includes a website for the Customer with online booking, a calendar and appointment management, records of customers, services, staff and opening hours, appointment e-mail notifications and connecting a custom domain, to the extent of the chosen plan.
Apointo may improve and change features of the Service, provided this does not materially reduce the agreed scope of the service.
3. Account and access
- The Customer provides accurate data and keeps it up to date.
- The Customer keeps sign-in credentials confidential and is responsible for the actions of persons it has given access to (staff, managers).
- The Customer notifies Apointo without delay of any unauthorised access at [privatnost@<domain>].
4. Plans, prices and payment
The price, scope and limits of a plan (for example the number of staff or services) are set by the current price list or an individual offer. Plan limits are applied automatically.
We notify the Customer of price changes at least 30 days in advance; a change applies from the next billing period.
If a subscription is not paid on time, the Service switches to a mode in which data can only be viewed and, after a further notice, may be suspended.
5. Customer obligations
- To use the Service in accordance with the law, in particular to display services and prices on its website accurately and completely as required by consumer protection law.
- To have a legal basis for the data of its customers and staff and to inform them about the processing, as controller (Article 23 of the Law on Personal Data Protection).
- To publish only content (photos, logo, texts) it has the rights to.
- Not to attempt to bypass security, disrupt the Service, access others' data or use the Service to send unsolicited messages.
6. The Customer and its clients
The contract for a service the Customer provides is concluded solely between the Customer and its client. Apointo is not a party to that relationship, does not charge for the Customer's services and is not responsible for their quality, for customers showing up or for cancellations.
7. Personal data
For the data of clients and staff the Customer is the controller and Apointo the processor. The parties' rights and obligations regarding that data are set out in the Data Processing Agreement. For user account data Apointo is the controller, as described in the Privacy notice.
8. Content and intellectual property
The Customer retains all rights to its content and grants Apointo a non-exclusive licence to store and display that content as needed to provide the Service, for the duration of the contract.
The Apointo software, design and trademark belong to Apointo. The Customer receives the right to use the Service for the duration of the contract, without the right to transfer or assign it.
9. Availability
Apointo takes reasonable measures to keep the Service continuously available but does not guarantee uninterrupted availability. Planned maintenance is announced in advance whenever possible.
Apointo is not responsible for interruptions caused by third parties outside its control, such as internet service providers or domain registrars.
10. Custom domain
A Customer who connects its own domain is responsible for its registration, renewal and DNS settings. Apointo connects the domain to the Customer's website and provides a certificate for an encrypted connection while the DNS settings are correct.
11. Suspension
Apointo may restrict or suspend the Service in the event of a breach of these terms, non-payment or a serious security risk. It notifies the Customer in advance, except where urgent action is needed to protect the Service or third parties. Data is kept during a suspension.
12. Term and termination
The Customer may cancel the Service at any time, effective at the end of the paid period. Apointo may terminate the contract with 30 days' notice, or immediately in the event of a serious breach of these terms.
When the contract ends, the Customer has 30 days to export its data, after which the data is deleted and disappears from backups within a further 30 days.
13. Liability
Apointo's total liability for damages is limited to the amount the Customer paid for the Service in the last 12 months. Apointo is not liable for loss of profit or indirect damage.
These limits do not apply to damage caused intentionally or by gross negligence (Article 265 of the Law on Obligations).
14. Changes to the terms
We notify the Customer of changes to these terms by e-mail at least 30 days before they take effect. If the Customer does not agree, it may cancel the Service before they take effect; continued use after that date counts as acceptance.
15. Governing law and jurisdiction
These terms are governed by the law of the Republic of Serbia. The parties will try to resolve any dispute amicably; otherwise the court of competent jurisdiction in Belgrade has jurisdiction.
The terms are drawn up in Serbian; translations are for information only. In case of discrepancy the Serbian text prevails.
